These Website Terms describe the conditions DriverSeek LLC applies to use of its public website, contact links, initial driver application, and invitation-only applicant portal. They do not replace any separate written agreement.
Scope and informational purpose
These Website Terms apply to the public website, initial driver application, and invitation-only applicant portal operated by DriverSeek LLC (DriverSeek). DriverSeek provides those features to describe school transportation staffing services, receive inquiries and applications, show a limited applicant status, maintain limited profile preferences, and request narrow post-approval credential evidence. Website content is general information, not legal, employment, licensing, safety, or transportation advice. The Privacy Notice separately explains how DriverSeek handles information. These Terms do not govern a separate school-service agreement or any later employment, contractor, placement, or other working relationship.
No employment or coverage guarantee
Submitting an application is only a request to be considered. It is not an offer or acceptance and does not create an employment, independent-contractor, agency, referral, placement, or service relationship. It does not guarantee an interview, qualification decision, assignment, route, schedule, hours, compensation, benefits, continued consideration, or future communication. A school inquiry does not create a service agreement or guarantee a particular driver, response time, staffing result, or uninterrupted coverage. Any later offer, assignment, or relationship must be communicated separately by an authorized representative and may be governed by a separate written agreement.
Applications and communications
Provide information that is accurate and that you are authorized to provide. Do not submit sensitive information identified in the Privacy Notice. You retain any rights you may have in material you submit and authorize DriverSeek to receive, host, copy, transmit, secure, and use it as reasonably necessary for the application process and as described in the Privacy Notice. DriverSeek may contact an applicant about recruiting or respond to an inquiry, but receipt of a message or application does not require DriverSeek to accept, respond to, or act on it.
Invited portal accounts
Portal access is invitation-only, personal to the approved applicant identified in the invitation, and subject to continuing backend authorization. Keep your password, authenticator, device, and recovery information secure; promptly report suspected access by another person. Do not share an invitation, session, or download link or use another person's account. DriverSeek may suspend or revoke access to protect a person, record, or system or to resolve eligibility, identity, security, or legal concerns. A recruiting approval, invitation, account, status display, or document request does not create a job offer, assignment, employment relationship, or independent-contractor agreement and does not promise work or authorize work.
Requested credential uploads
Upload only the exact document DriverSeek requests for your account and category, and only if you are authorized to provide it. For the initial portal, that means a separate CPR certificate or first-aid certificate; no combined packet or unrelated file is allowed. Do not upload the prohibited identifiers, license or clearance images, medical, background, tax, bank, student, or other records listed in the Privacy Notice. You retain any rights you have in an allowed upload and authorize DriverSeek and its service providers to receive, scan, validate, encrypt, copy, review, retain, back up, make available to authorized users, and delete it for the purposes and periods described in the Privacy Notice. Malware or format screening is not credential acceptance, and DriverSeek may reject, restrict, supersede, or request replacement of a file through the documented workflow.
Acceptable use
Use the website only for lawful purposes and through its intended public or authorized administrator features. Do not impersonate another person, submit another person's information without authority, introduce malicious code, interfere with or overload the website, attempt to access nonpublic systems or information, circumvent authentication or security controls, scrape personal information, or use the website to violate another person's rights. DriverSeek may restrict access as reasonably necessary to protect the website, its users, or its operations. Nothing in this section prohibits conduct protected by applicable law or activity expressly authorized by DriverSeek in writing.
Accessibility and application assistance
If you need help accessing the website or completing the initial application, contact DriverSeek to discuss an available alternative or reasonable assistance. Requesting assistance will not by itself affect consideration of an application. Nothing in these Terms limits a right to request an accommodation or exercise another right protected by applicable law.
Intellectual property
The website's original text, design, graphics, software, and branding are owned by DriverSeek or its licensors and are protected to the extent provided by applicable law. DriverSeek grants limited, nonexclusive, nontransferable permission to use the public website for its intended informational and application purposes. No other license is granted. DriverSeek names, logos, and brand elements may not be used to imply sponsorship, endorsement, or affiliation without written permission.
Third-party services and links
The website relies on service providers for hosting, security, authentication, and communications and may contain links to websites DriverSeek does not control. Service providers may process information on DriverSeek's behalf as described in the Privacy Notice. External websites are governed by their operators' terms and privacy practices; a link does not imply endorsement, and DriverSeek does not guarantee an external website's availability.
Availability and disclaimers
Except for express statements made by DriverSeek and to the fullest extent permitted by law, the public website and its content are provided “as is” and “as available.” DriverSeek does not promise uninterrupted or error-free availability, that every defect will be corrected, or that website content will always be complete or current. This section does not disclaim an obligation imposed by law or the Privacy Notice, qualify a specific representation elsewhere on the website, or alter rights under a separate signed agreement.
Governing law
These Terms are governed by Arizona law, without regard to conflict-of-law principles, except where federal or other mandatory law applies. Subject to applicable jurisdiction and mandatory venue rules, a proceeding concerning the public website may be brought in a court of competent jurisdiction in Maricopa County, Arizona, or the United States District Court for the District of Arizona.
Nonwaivable rights and separate agreements
Nothing in these Terms limits a right or remedy that cannot lawfully be waived, including applicable rights under employment, anti-discrimination, accessibility, privacy, data-security, or consumer-protection law. Nothing prohibits reporting concerns to or communicating with a government agency, participating in an investigation, or exercising protected rights. Mandatory law controls if it conflicts with these Terms. A separate signed agreement controls to the extent it expressly conflicts with these website-specific Terms.
Changes to these terms
DriverSeek may revise these Terms prospectively by posting the revised version and a new effective date. DriverSeek will provide prominent advance notice when appropriate for a material change affecting applicants. Revised Terms apply only from their stated effective date and do not retroactively alter a previously submitted application or separate agreement. DriverSeek will request new affirmative assent when applicable law or the nature of a change requires it.
